About this template
This page is a template. It must be reviewed by a Canadian lawyer and an insurance professional before it is used with real customers.
Text in [square brackets] is a placeholder or a suggested default that the business owner must confirm or replace.
In this page, “we”, “us” and “FilmRental” mean [Legal entity name], operating as FilmRental at filmrental.ca. “You” means the person or company renting from us.
Coverage is required
Every rental must have one of two kinds of coverage: your own insurance (a certificate of insurance), or our damage waiver.
We cannot release equipment until coverage is confirmed.
Option 1: your certificate of insurance (COI)
Send us a certificate of insurance (COI) from your insurer before pickup. [Suggested: at least 24 hours before pickup.]
The COI must show FilmRental ([Legal entity name]) as loss payee and/or additional insured, cover rented equipment for its full replacement value, and be valid for the whole rental period.
We may refuse a COI that is incomplete, expired or does not cover the equipment type (for example, drones).
Option 2: our damage waiver
You can buy our damage waiver for 10% of the rental cost.
The damage waiver is not insurance. It is a contract term under which we agree to limit what you owe us for covered accidental damage, up to the limits set out here.
[Deductible amount]: you pay the first [deductible amount] of each covered claim.
What the damage waiver does not cover
The damage waiver does not apply to:
- theft from an unlocked or unattended vehicle
- negligence, carelessness or intentional damage
- water damage and damage from sand, dust or extreme conditions
- misuse or use against the manufacturer’s instructions
- loss of small accessories (batteries, cables, caps, filters, cards)
- use by someone who is not named in the booking
- [other exclusions to be confirmed by the owner and insurance professional]
Making a claim
Tell us about any damage or loss as soon as possible and no later than the return of the equipment. For theft, file a police report right away.
If you use your own insurance, you remain responsible to us for any amount your insurer does not pay.
Liability
Neither the COI nor the damage waiver covers injury to people or damage to third-party property caused by your production. You should have your own liability insurance for that.
We recommend that you speak with your insurance broker about your production.
